1. Acceptance of these Terms

By creating an account, accessing baseballbettingbot.com (the “Site”), or subscribing to any paid plan, you agree to be bound by these Terms & Conditions (the “Terms”) and the Privacy Policy. If you do not agree, do not use the Site. The Site is operated by a private individual, not by an incorporated entity; references to “we,” “us,” or “our” refer to that operator.

2. What we provide

The Site displays the historical performance and forward-looking probabilistic predictions of a privately developed XGBoost model for Major League Baseball moneyline outcomes. Subscribers may also view a “Pick of the Day” and a list of model picks for that day. All output is generated by an automated system and is provided “as is.”

3. Eligibility & legal use

• You must be at least 21 years old (or the legal gambling age in your jurisdiction, whichever is greater) to use the Site.
• You are solely responsible for confirming that any wagering you choose to do based on the Site’s content is legal in your jurisdiction. We do not accept wagers, hold funds, or operate as a sportsbook.
• The Site is intended for users in jurisdictions where viewing sports analytics content is lawful. If it is not lawful where you are, you must not access the Site.

4. No financial, gambling, or professional advice

The information, statistics, probabilities, edge calculations, confidence ratings, and picks displayed on the Site are not financial, investment, gambling, tax, or any other form of professional advice. They are the output of a model and may be inaccurate, incomplete, delayed, or wrong. Past performance shown on the Site is not indicative of future results. You should not rely on the Site as the sole basis for any decision to wager money.

5. Assumption of risk

Sports betting carries a substantial risk of financial loss. By using the Site you acknowledge and accept that:

• Any wagers you place are your own decision and at your own risk.
• You may lose some or all of the money you wager.
• We do not guarantee any win rate, return on investment, edge, or profit.
• We are not responsible for any losses, missed opportunities, or consequences arising from your use of the Site.

6. Subscriptions, billing, and trial

• Paid access is offered as a recurring subscription billed at US$7.99 per month after a 5-day free trial, unless a different price is shown at checkout.
• Payment is processed by Stripe. By starting a trial you authorize Stripe to store your payment method and to automatically charge it at the end of the trial and at each renewal until you cancel.
• You can cancel at any time from the “Manage” menu. Cancellation stops future renewals; access continues through the end of the current billing period.
• Except where required by law, all fees are non-refundable. We do not offer refunds for partial billing periods, unused time, or losing wagers.
• We may change pricing at any time. Price changes will not affect an active billing cycle, and we will provide reasonable notice before they take effect on renewal.

7. Promo codes

Promo codes (including any “lifetime” grants) are issued at our sole discretion, are non-transferable, have no cash value, and may be revoked at any time, including for abuse, fraud, sharing, or use across multiple accounts.

8. Account security

You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately of any unauthorized use. We are not liable for losses caused by your failure to safeguard your account.

9. Acceptable use

You agree not to:

• Scrape, mirror, redistribute, resell, or commercially exploit any content from the Site without our written permission.
• Reverse engineer, copy, or attempt to derive the underlying model or proprietary data.
• Share your account, paid content, or picks with anyone outside your household.
• Use the Site to violate any law, gambling regulation, or sportsbook’s terms of service.
• Probe, attack, overload, or attempt to bypass any security or access-control feature of the Site.

10. Intellectual property

All content on the Site, including the model, code, picks, charts, copy, and branding, is owned by the operator of the Site and is protected by copyright and other laws. Subscribing grants you a personal, revocable, non-exclusive, non-transferable license to view the content for your own non-commercial use. No other rights are granted.

11. Third-party services

The Site relies on third-party providers including Supabase (authentication, database, storage), Stripe (payments), and public MLB and odds data sources. We are not responsible for the availability, accuracy, or actions of those third parties, and your use of their services is governed by their own terms.

12. No warranties

The Site and all content on it are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, uninterrupted access, or that any pick will be profitable. We do not warrant that the Site will be free of errors, bugs, downtime, or data delays.

13. Limitation of liability

To the maximum extent permitted by law, in no event will the Site, its operator, owners, contributors, affiliates, or service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, wagers, or business opportunities, arising from or related to your use of the Site, even if advised of the possibility of such damages.

Our aggregate liability to you for any and all claims arising out of or relating to the Site or these Terms is limited to the greater of (a) the total fees you paid us in the three (3) months immediately preceding the event giving rise to the claim, or (b) US$25.00.

14. Indemnification

You agree to indemnify, defend, and hold harmless the Site, its operator, owners, contributors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from (i) your use of the Site, (ii) your wagers or financial decisions, (iii) your breach of these Terms, or (iv) your violation of any law or third party’s rights.

15. Termination

We may suspend or terminate your account or access to the Site at any time, with or without notice, for any reason, including for breach of these Terms. Upon termination, your right to use the Site ends immediately. Sections that by their nature should survive termination, including Sections 4, 5, 9, 10, 12, 13, 14, and 17, survive.

16. Responsible gambling

17. Governing law & dispute resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site shall be resolved exclusively by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, in English, with the seat in Wilmington, Delaware. You waive the right to participate in a class action or class arbitration. Either party may seek injunctive relief in court for misuse of intellectual property.

18. Changes to these Terms

We may update these Terms at any time by posting a new version on this page and updating the “Last updated” date. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms. Material changes affecting paid features will be communicated by email or in-app notice where reasonably practical.

19. Severability & entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Site and supersede any prior agreements.
